1. Scope of Delivery

I ship worldwide. The mode of transport and carrier are selected individually depending on the dimensions of the artwork and the destination country, to ensure the maximum safety of the shipment.

2. Order Fulfillment Time

I make every effort to prepare and ship your order as quickly as possible. Orders are typically shipped within a few business days; however, the maximum fulfillment period is 21 calendar days from the date the contract is concluded — except for paintings covered by the special delivery model described below.

Exception — "In the Footsteps of Claude Monet" collection: paintings from this collection are sold under a deferred delivery model, linked to the exhibition of these works being held in Warsaw. Payment and invoicing are completed immediately at the time the order is placed, while physical delivery of the painting will take place after the exhibition ends, no later than October 31, 2026. This deadline constitutes the time of performance agreed between the parties within the meaning of Article 12(1)(15) of the Polish Consumer Rights Act. Details are set out in the Refund Policy [LINK], section 1a.

3. Shipping Costs

Delivery costs are borne by the customer. The exact shipping price is shown before the order is finalized.

4. Customs Duties and Import Taxes

The prices listed in the Store do not include any customs duties, import taxes, or customs fees imposed by the destination country. Any such fees are borne by the buyer and are collected by the relevant customs authorities of the destination country. I have no influence over their amount and am not liable for them. Before placing an order, I recommend reviewing the customs regulations applicable in the country of delivery.

5. Responsibility for Delivery Details

The customer is required to provide correct and complete address information. If a reshipment becomes necessary due to incorrect information provided by the customer, the cost of the reshipment will be charged to the buyer.

6. Packaging and Security

Paintings are packaged with the utmost care, often in individually prepared packaging tailored to the specific artwork. I make every effort to ensure each shipment is properly secured and insured — however, the insured value and terms may vary depending on the carrier and the destination country.

7. Transfer of Risk

The risk of accidental loss or damage to the product passes to a consumer customer upon physical receipt of the product from the courier or postal operator. For customers purchasing as entrepreneurs (purchase made with a NIP/tax ID), the risk passes to the customer at the moment the shipment is handed over to the courier.

8. Damage in Transit and Complaints

In the event of damage to a shipment during transport, or receipt of a non-conforming product, please contact me promptly and provide supporting documentation (e.g., photographs, a damage report from the courier). Preparing a damage report upon receipt from the courier significantly facilitates the claims process against the carrier.

I process complaints within 14 calendar days of their receipt. A response will be sent to the e-mail address provided with the order. Failure to respond within this period means the complaint is deemed justified, in accordance with Article 7a of the Polish Consumer Rights Act.

9. Returns

Return terms are set out in the separate Refund Policy [LINK].

10. Contact

For matters related to shipping, I recommend contacting me by e-mail at: kacper.ogaza@gmail.com. This form of contact allows for efficient handling of your request and maintains complete documentation.

11. Final Provisions

Matters not regulated by this Shipping Policy are governed by Polish law, in particular the Polish Civil Code and the Polish Consumer Rights Act, without prejudice to the mandatory consumer rights applicable in the consumer's country of residence.
