2. Nature of the Information

The content published on the website, in particular descriptions of the artworks, pricing information, and availability, constitutes an invitation to enter into a contract within the meaning of Article 71 of the Polish Civil Code, and does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. I make every effort to ensure the information is accurate; however, unintended technical errors may occur.

3. Limitation of Liability

I am not liable for:

  • technical interruptions in the operation of the service resulting from causes beyond my control (force majeure, actions of third parties),
  • damages resulting from use of the website in a manner inconsistent with its intended purpose,
  • decisions made on the basis of information published on the website.

The above limitations do not infringe upon consumers' statutory rights — with respect to consumers, my liability is governed by the mandatory provisions of Polish law.

All content published on the website, in particular images, photographs of the artworks, descriptions, and graphic elements, constitutes my intellectual property and is protected under the Polish Act on Copyright and Related Rights.

Purchasing a painting means acquiring its physical copy, but does not result in the transfer of copyright (economic rights) or the granting of a license for its further commercial use. Copying, reproducing, modifying, or distributing images of the artworks without my prior written consent is prohibited.

5. Dispute Resolution

Consumers may make use of out-of-court methods of complaint handling and claims resolution. In particular:

  • via the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr
  • through the Provincial Inspector of Trade Inspection — the option to file a request to initiate mediation proceedings
  • through the Permanent Consumer Arbitration Court at the Provincial Inspectorate of Trade Inspection — the option to file a request for dispute resolution

The use of the above options is voluntary and does not exclude the right to pursue claims in court.

6. Governing Law

Polish law applies to the use of the website and to any contracts concluded through it. The choice of Polish law does not deprive the consumer of the protection afforded to them under the mandatory provisions of the law of the country of their habitual residence, which cannot be excluded by agreement.
